How quickly must I file a lawsuit if I was injured in the car accident?

Return to FAQ Videos

Transcript:

There is no time other than the statute of limitations for a particular case. Typically, it’s four years in an auto negligence case. However, it does make sense to file a lawsuit within a certain amount of time practically speaking, which is kind of normal for these types of cases. The first thing you do is you collect all the data, all the evidence you can to see if you can resolve the case without filing a lawsuit. That’s expected. However, if you’re not getting anywhere at that time, it would be a good idea to file the lawsuit. Don’t wait a year, two years, three years if you can avoid that because it does get stale. First thing is your health, you then try to settle. If you cannot settle, you do file the lawsuit as fast as you can.
