You can absolutely still sue and recover for your injuries. The important thing in this case that you seem to be suggesting, is that the at fault driver has insurance, so that’s a good situation if you indeed have that, but even if they don’t have insurance, there may be assets available by the at fault person that you can go after. You don’t always have to have insurance involved, and keep this in mind, it’s not always the actual drivers involved. It may be the owner of the vehicle that you can go after that insurance, or it may be a property owner nearby who has created a dangerous situation, which has contributed to this accident.
That’s why you need to get counsel to review all the various situations that exist, all the potential parties who may be at fault, so you can look for coverage.
