What are the legal distinctions between possession, dealing, and trafficking in controlled substances in Florida?Return to FAQ Videos
It all has to do with the elements of the crime, the amount of the drugs, and what you’re doing with the drugs. If you think about personal use, that’s going to be possession. If you think about dealing, it’s one person selling to the other, doing it for money, doing it for profit, and that’s a bigger crime, and then you get into trafficking, bigger amounts, bigger parties, multiple people and that’s an even bigger felony. It really depends on what you’re doing with the drug and how much drugs you have and what the state can prove as to whether they charge you with possession, dealing, or trafficking, three very different sub-crimes.
