A permanent injury can be many things. In Florida, we actually have it detailed. There’s elements to what a permanent injury is. It typically means a loss of sense or bodily function and there’s other elements to that. In essence, it’s a permanent inability to use your body in a way that you used to do it before the accident. It can include pain. It can include loss of motion. Of course, loss of limb is actually identified in the Florida statutes as a permanent injury. It’s a matter that has to be proven for pain and suffering damages. You will need to prove permanent injury if you are trying to get those types of damages.
