Who can I sue to recover damages in a Florida auto accident case?

Return to FAQ Videos

Transcript:

Probably more than you think, in terms of who might be responsible in a car accident case. Most people don’t know that the owner of the vehicle is responsible, assuming that the driver of that vehicle is at fault, even though the owner wasn’t there. That’s under the vicarious liability doctrine that we have in the State of Florida.

Obviously the person driving the car is at fault, and a property owner nearby may be at fault because they have a dangerous condition on their property that they should have known about and taken care of. For instance, shrubbery that’s in the way of being able to detect other vehicles coming down the road. That sort of thing.
